I hereby agree on ___________________ to breed the mare named below to Oaxaca Chexx, AQHA, using cooled transported semen, for the 2017 season subject to the following conditions:

The Stallion Fee is $800.00, which shall be payable upon execution of this contract. (A minimum of ten (10) days prior to semen being shipped.)

Mares on the premises of Brazile Quarter Horses have a breeding priority on any given breeding day; therefore we make no guarantee cooled semen will be available for a specific day.

There is a $150.00 charge for each shipment of cooled transported semen. There is a limit of four shipments per breeding season per mare. The first $150.00 shipping fee is due ten (10) days prior to the first shipment of cooled transported semen.

Mare owner is responsible for return of Equitainer within 48 hours by normal (Priority Overnight) on United Parcel Service (UPS) or Federal Express (Fed-Ex). Equitainer not returned are invoiced at replacement costs.

A request for shipment of cooled transported semen must be made at least 24 hours prior to shipping time. Cancellation must be made by 8:00 am shipping day.

A LIVE FOAL GUARANTEE will only apply as stated below:

A live foal is described as a new born foal, which stands and nurses without assistance.

For mares that conceive from the use of Cooled Transported Semen, a documented ultrasound photo will be required within 45 days from the last date of shipment. If an ultrasound photo is not received, THE REBREED BECOMES NULL AND VOID. Should mare not produce a live foal from this breeding, a will be honored the following year.

Brazile Quarter Horses agrees to ship cooled transported semen as described above. If a mare fails to settle for any reason, mare owner will hold Brazile Quarter Horses blameless.

A Breeder's Certificate will be issued for the foal conceived by this mating when all fees and other expenses have been paid in full; and, when mare has produced a live foal by this mating.

The parties acknowledge that this agreement is made and shall be entirely performed within the State of Texas and shall be construed and enforced under the laws of the State of Texas. Under Texas Law (Chapter 87, civil practice and remedies code), an Equine Professional is not liable for an injury or the death of a participant in Equine activities resulting from the inherent risks of Equine activities.

This contract shall be binding upon the parties hereto, upon execution hereof and the same may not be altered or amended, except by written mutual consent of the parties hereto.

A PHOTOSTATIC COPY, BOTH SIDES THEREOF, OF THE REGISTRATION PAPERS ON YOUR MARE MUST ACCOMPANY CONTRACT. OWNER RECORDED ON REGISTRATION CERTIFICATE WILL BE RECORDED ON THE STALLION BREEDING REPORT.
